With the current facility, Walsh County faces increased liability due to the following concerns:

• Safety Risks for County Employees and Inmates: Inadequate facilities pose safety concerns to County employees and their ability to move inmates in a safe manner, to monitor inmates appropriately, and to perform their duty to protect inmates from each other.

• Health and Mental Health Concerns: Inadequate facilities pose safety concerns to inmates dealing with a medical issue, a mental health crisis, or those who have a high suicide risk.

• Loss of Direct Oversight: Walsh County remains responsible for inmates in its custody, even when they are housed in other jurisdictions. However, housing inmates elsewhere limits the County’s ability to ensure consistent standards of care and oversight.
